Assalamu alaikum. Afwan ustadz, bagaimana hukumnya penyelenggara arisan mengadakan arisan barang, tp ia mengambil untung dg uang.
Misalnya barang harganya 1jt, tp d jadikan arisan 10 org dg masing-masing 120rb selama 10 kali. Dan penyelenggara arisan itu mengambil untung sebesar 200rb dlm arisan tsb. Bagaimana hukumnya ustadz ? Jazakallahu khoir (+62 813-3434-xxxx)
JAWABAN
Wa’alaikumussalam wa Rahmatullah wa Barakatuh
Ada dua hal:
– Arisan pada dasarnya dibolehkan, karena substansinya akad hutang, dengan syarat bebas dari riba.
Arisan barang, pada prinsipnya dibolehkan dengan syarat harga barang tetap selama satu siklus arisan. Jika harga barang berubah naik sehingga bertambah cicilan peserta arisan maka itu menjadi riba. Karena adanya penambahan nilai hutang.
– Jika arisan 120 ribu rupiah, dengan rincian:
100 ribu rupiah buat bukunya
20 ribu rupiah buat upah penyelenggara, maka hal itu dibolehkan dengan akad ijarah (sewa) atas jasa penyelenggara: mencatat, menagih, mengumpulkan, dan membelikan bukunya. Asalkan semua pihak ridha atas akad ijarah tersebut.
